Yummies on the ‘MOO’ve

1. DEPOSIT
A deposit of $100 is due at the time this contract is confirmed by CATERER. It is to be deducted from the Total Final Payment.
2. FINAL PAYMENT
The Final Payment amount will be billed to the CLIENT within three (3) days of services rendered. CLIENT will then have seven (7) days to complete the payment.
3. COST
The Cost to be paid by CLIENT includes the $200 set up fee plus per serving and tax.
3.1 The price category is determined by the number of servings ordered at the Event.
3.2 CLIENT will be charged a minimum of fifty (50) servings.
3.3 If you select that your party will be over 100 people, you will automatically be charged for 100 servings
3.4 The price categories are: $4.50 per serving for up to 100 servings
$4.25 per serving for 101-200 servings
$4.00 per serving for 200+ servings
4. PAYMENT METHOD
All prices quoted are based on cash payments.
4.1 Payment by Credit Card will be subject to a service charge of three percent (3%) per the amount of transaction.
5. SERVINGS COUNT
The Servings Count will be kept by CATERER.
5.1 Children and adults both count as one (1) Serving.
5.2 Each dish handed out will be counted as one (1) Serving, regardless of the chosen toppings.
5.3 CATERER is not responsible for guests who come up for more than one (1) Serving OR for those not a part of the event coming up for a Serving.
6. TRAVEL
CATERER will Travel up to fifteen (15) miles from our location at 12 Center St. Warsaw, NY, at no additional charge. The CLIENT will be charged an additional $3 per mile traveled by the CATERER beyond the given fifteen (15) miles.
7. TIME
CATERER will serve for up to one (1) hour, unless an agreement has been made between both parties and is noted under the Particulars.
7.1 If CATERER must stay for longer than the one (1) hour for any reason, CLIENT will be billed an additional $75 per hour.
13. CHANGE OF DATE
A Change of Event Date must be requested by CLIENT at least thirty (30) days prior to the Event’s currently booked Date. If CATERER is not able to accommodate the new Date, the deposit will be refunded.
14. CHANGE OF VENUE
A Change of Venue must be requested by CLIENT at least seven (7) days prior to the Event. Additional charges may apply if the new Venue is outside of the fifteen (15) mile Travel radius.
15. CANCELLATION BY: CLIENT / VENUE
The deposit is returned in full if the event is canceled by CLIENT, or the venue, more than thirty (30) days prior to the Event’s Date.
16. CANCELLATION BY CATERER
CATERER reserves the right to terminate this contract for any valid reason.
18.1. IF CATERER terminates this contract, the deposit will be returned in full within seven (7) days.
17. DAMAGE
CATERER assumes no responsibility for ANY damage during or after the event.
18. CATERER LIABILITY:
CLIENT absolves CATERER from any third party claims, except for actions caused by CATERER and/or negligence of its employees.
19. TAXES
CLIENT will be charged the applicable current rate for all services rendered as determined by the concerned government body.
20. UNLAWFUL ACTIVITIES:
The CLIENT will comply with all the laws of the United States of America and the State of ­­­­­­New York, all municipal ordinances and all lawful orders of police and fire departments, and will not do anything on the event/function premises in violation of any laws, ordinances, rules or orders. If unlawful activities should occur on the premises, and the event is cancelled, there will be no refund of any kind from CATERER to CLIENT.
21. GOVERNING LAW
This Agreement shall be governed by and construed in accordance with the laws of the USA.
